On September 29, Professor Jason Cieslik presented an ongoing research project titled “Usurping Authority—Illinois Sheriffs Declare Law Unconstitutional.” Professor Cieslik notes that on January 10, 2023, Gov. Pritzker signed legislation (PICA) prohibiting the sale, possession, and distribution of assault weapons. One particular provision within the statute requires current owners of assault weapons to file an endorsement affidavit with the Illinois State Police identifying the weapons that they own. In response, a vast majority of the Illinois sheriffs stated that they would not enforce this provision on the basis that it violated a citizen’s Second Amendment rights. The presentation explored whether the office of the sheriff has the Constitutional authority to declare a law unconstitutional and whether there are any consequences for a sheriff violating a duty to enforce a law. The hybrid event allowed for additional attendees through Zoom as well as an in-person audience.
